USER AGREEMENT, DISCLAIMER,
KVKK & GDPR INFORMATION NOTICE AND LEGAL UNDERTAKING

This agreement is executed between real or legal persons who purchase and/or use products belonging to the Bagulan brand (“User”) and Bagulan (“Seller”), and shall be valid prior to the purchase and use of the product.

By approving this document electronically, the User declares that they have read, understood, and accepted the entire agreement voluntarily and without any pressure.

1. PRODUCT CHARACTERISTICS AND INTENDED USE

Bagulan products are general-purpose electronic hardware developed for the purposes of:

  • education
  • research and development
  • testing
  • hobby use
  • lawful security studies

Bagulan products do not encourage, direct, or support any unlawful activities, including but not limited to:

  • illegal activities
  • unauthorized access
  • sabotage, attacks, unauthorized surveillance
  • actions disturbing public order
  • terrorism, criminal organizations, intelligence activities
  • violations of personal data

2. FULL RESPONSIBILITY ARISING FROM USE

The User acknowledges and declares that:

  • the manner, location, and purpose of use of the product are entirely under their own control,
  • all direct or indirect legal, criminal, and administrative liabilities arising from the use of the product belong solely to the User,
  • the Seller has no authority to monitor or intervene in the actual use of the product.

3. ILLEGAL USE, TERRORISM, AND CRIMINAL LIABILITY

The User acknowledges that:

  • they shall not use the product for any activity contrary to applicable national or international legislation,
  • in the event that the product is used in criminal acts, terrorist activities, or in a manner that causes harm to third parties, all criminal and legal responsibility shall belong exclusively to the User,
  • Bagulan, its executives, employees, and business partners shall not be held liable in any manner due to such use.

4. RED TEAM / OFFENSIVE SECURITY WARNING (SPECIAL CLAUSE)

Bagulan products may be suitable for use in high-risk areas such as:

  • cybersecurity testing
  • Red Team / Blue Team operations
  • penetration testing

However, the User acknowledges in advance that:

  • such activities may only be carried out within the scope of written authorization and permission,
  • any unauthorized testing constitutes a criminal offense,
  • all consequences arising from such use belong entirely to the User.

5. DISCLAIMER

Bagulan shall not be liable for any material, moral, or criminal damages arising from:

  • user error
  • incorrect configuration
  • unauthorized use
  • unlawful activities
  • damages suffered by third parties

Any claims, lawsuits, or investigations brought against Bagulan for these reasons shall be entirely the responsibility of the User.

6. IDENTITY, ADDRESS, AND DECLARATION OBLIGATIONS

The User acknowledges that:

  • all information provided during the purchase is accurate, up to date, and belongs to them,
  • they shall be solely responsible for any consequences arising from false or misleading information,
  • such information may be shared with official authorities upon lawful request.

7. COOPERATION WITH COMPETENT AUTHORITIES

Bagulan reserves the right to share user information within the scope of legal obligations upon duly submitted requests by:

  • public prosecutors’ offices
  • courts
  • law enforcement agencies
  • authorized administrative authorities

This situation shall be deemed accepted by the User in advance.

8. INDEMNIFICATION OBLIGATION

The User agrees to immediately and fully indemnify Bagulan for all damages, expenses, and legal costs incurred due to:

  • unlawful use
  • misleading declarations
  • claims made by third parties.

9. DISTANCE SALES AND RIGHT OF WITHDRAWAL

The product is sold under distance sales regulations.

However, since the product is electronic hardware, the right of withdrawal cannot be exercised if:

  • the product has been used,
  • any intervention has been made, or
  • modifications have been performed.

10. PROTECTION OF PERSONAL DATA (KVKK & GDPR)

The User acknowledges that they give explicit consent for the processing of their personal data within the scope of the Turkish Law on the Protection of Personal Data No. 6698 (KVKK) and the GDPR.

Processed Data:
  • identity and contact information
  • address, billing, and order information
  • IP and device information
Purposes:
  • sales and delivery
  • fulfillment of legal obligations
  • prevention of abuse and misuse

Personal data shall be retained for the periods stipulated by legislation and shall be deleted, destroyed, or anonymized upon expiration of such periods.

The User has the right to access, rectify, delete, and object to the processing of their personal data.

11. GOVERNING LAW AND JURISDICTION

Any disputes arising from this agreement shall be governed by the laws of the Republic of Türkiye, and the courts of the Seller’s place of residence shall have jurisdiction.

12. EFFECTIVENESS AND APPROVAL

By checking the box stating “I have read, understood, and accept,” the User acknowledges and declares that:

  • they accept all provisions of this agreement,
  • they purchase the product under these terms,
  • they shall not raise objections thereafter.
