Distance Sales Agreement

1. PARTIES

2. SUBJECT AND SCOPE

This Agreement regulates the rights and obligations of the parties under Turkish consumer and distance sales legislation in relation to the sale and delivery of the product/service ordered electronically by the Buyer through the Seller’s website www.breachion.com.

3. PRODUCT/SERVICE, PAYMENT AND DELIVERY

• Product/Service Characteristics: As specified on the website, including technical specifications and scope.
• Sales Price: Total amount including taxes shown on the order confirmation screen.
• Delivery Method:
  • Digital Products: Delivered instantly after payment confirmation via e-mail and/or in-site access.
  • Physical Products: Delivered to the specified address via cargo within 30 days at the latest following the establishment of the contract.

4. RIGHT OF WITHDRAWAL AND EXCEPTIONS

The Buyer has a right of withdrawal within 14 (fourteen) days in contracts for the delivery of goods without giving any reason. However, pursuant to relevant distance contracts regulations, the right of withdrawal cannot be exercised in the following cases:

• Digital Content: Services performed instantly in electronic environment or intangible goods delivered instantly (software, license keys, digital content, etc.).
• Personalized Production: Goods prepared in line with the consumer’s requests or personal needs.
• Services Started with Approval: Services whose performance has started with the consumer’s approval before the withdrawal period ends.

5. GENERAL PROVISIONS

• Accuracy of Information: The Buyer accepts that all information provided during membership and ordering is accurate and is responsible for damages arising from incorrect information.
• Payment Obligation: By confirming the order, the Buyer accepts the obligation to pay the specified price and any additional fees (shipping, taxes, etc.).
• Force Majeure: The Seller cannot be held responsible for events beyond the parties’ control (natural disasters, cyber attacks, etc.) preventing performance; however, the Seller shall notify the Buyer within 3 days.
• Intellectual Property: All rights to software, code and designs provided via www.breachion.com belong to Sümeyye Şayak - Breachion Technology and may not be copied or distributed without permission.

6. RETURN PROCEDURE

• Refund Channel: Where the right of withdrawal applies, refunds are made within 14 days using the same payment method (Credit Card/Bank Transfer).
• Bank Processing: For credit card refunds, reflection on the Buyer’s statement may take 2-3 weeks depending on bank procedures.

7. DISPUTE RESOLUTION

In disputes arising from this agreement, Consumer Arbitration Committees are authorized up to the value announced annually by the Ministry; for amounts above that threshold, Consumer Courts at the Buyer’s or Seller’s place of residence shall be authorized.

8. EFFECTIVENESS

The Buyer shall be deemed to have accepted all terms of this agreement upon completing the payment for the order placed via the website.
